Elder Law
Attorneys Mark Tunnell, left, and J. Stoddard Hayes, Jr., far right, meet with a client.
Our attorneys work with and advise clients at all stages of their lives. To help clients plan for retirement and beyond, we have developed an elder law practice that is focused on the special needs of seniors and their families. Elder law is a broad practice area, defined largely by the age of the client. This practice area includes matters such as asset protection, long-term care, nursing home litigation, age discrimination and specialized estate and retirement benefits planning.
In situations where our elderly clients have been financially exploited, our attorneys will attempt to obtain compensation for their losses. Our attorneys can also obtain emergency intervention for seniors who are being abused or neglected in nursing homes or by care givers. At Gawthrop Greenwood, our elder law attorneys are experienced court practitioners, who can handle complicated will contests, guardianships for the incapacitated, cases involving fiduciary liability and the removal of executors, claims of fraud or misuse of a family member's assets, and disputes concerning powers of attorney and trust investments. When mediation is an appropriate alternative, our attorneys can help our clients navigate a court-approved program to resolve serious problems before trial.
Some of the topics affecting our elder clients include:
- Asset protection
- Long-term care
- Nursing home litigation
- Age discrimination
- Specialized estate planning
- Living wills
- Guardianships
